The Terms contain important information about your rights and responsibilities. If you do not accept these Terms, please do not use this Service.The terms «Ensuria» ,"we", "us" or "our" in these Terms refer to Ensuria Operations Ukraine LLC (USREOU code: 43812574 ), which provides services and monitors the services provided. Technical support is provided by Ensuria Technologies OÜ, registered at Tornimäe tn 7-132, 10145, Tallinn, Estonia The collection and use of personal data in connection with your use of the Service is carried out in accordance with our Privacy Policy. Full agreement
These Terms and any policies, including our Privacy Policy, published through the Service constitute a full legally binding agreement between you ("you" or "the user") and Ensuria regulating your use of the Service.By using the Service, you hereby declare and confirm that:- You have read the Terms, understand their content and agree to abide by these Terms in full;
- You are at least 18 years old (otherwise you may use the Service only with the participation of parents or guardians);
- The law of your country does not restrict you from using the Service;
- You comply with applicable law.
Account registration
To use the full functionality of the Service and purchase policies, you need to register a personal account Account, providing your contact information and confirming your phone number with a one-time SMS password. Further, use the specified phone number to log in to your Account on the website or in the mobile application.In the personal account you can view the list of active and previously purchased policies, as well as save data for insurance. You must provide accurate, reliable and complete information in your profile and keep it up to date. Learn more about how we process personal data in our Privacy Policy. You may not transfer or share your Account with others. You are responsible for maintaining the confidentiality of your account login information and are responsible for all actions taken through your Account.You are responsible for ensuring that your use of the Service and the Account does not conflict with applicable laws, rules or other regulations. If you know or for any reason suspect that someone has illegally accessed your Account, please let us know immediately. To delete your account and saved data, please send us a request to care@ensuria.comEnsuria service
Ensuria digital insurance service is designed to quickly find, purchase and use insurance policies offered by insurance companies. With the Ensuria website and mobile application, you can view and compare the insurance offers, and get acquainted with the proposed insurance terms and sample contracts with the insurer.Ensuria acts as an agent, assistance and claims handler for such insurance companies based on agreements concluded with them. Please note that Ensuria is not an insurer, and operates in partnership with insurance companies on the basis of contracts.Users of the Service enter into an insurance agreement with insurers that offer the policies set out on the website in electronic form using an electronic signature with a unique identifier. In the event of an insured event, the Ensuria insurance service provides full support and compensation on behalf of the insurance company.You can also contact our support with any questions regarding the purchase and use of insurance policies through the Service at the contact details provided on the website and in the mobile application. Ensuria Support is available 24 hours a day.Making an order
Before purchasing the policy, carefully check the insured(-s) data and the insurance terms on the Ensuria website and mobile app. Read the insurance contract and conditions. The data in the policy cannot be changed after signing the contract with the insurer with a one-time identifier and payment of the order. Mistakes in the data you provided are grounds for termination of the contract and/or refund.The insurance policy order is paid on our website using Google Pay, Apple Pay, a third-party payment provider LiqPay or according to the specified details to the Ensuria account. You can pay for the order according to the details before the policy activation date. If there is no payment, the policy order is canceled automatically. When paying for orders with LiqPay, you must comply with the terms and conditions of the services and other LiqPay policies. Ensuria is not responsible for payment data processed by Google Pay, Apple Pay, or LiqPay providers according to their privacy policies.When the insurance company receives the payment confirmation, a letter with the insurance policy will be sent to your e-mail in PDF format. The policy will also appear in the Ensuria app.Any payments made with LiqPay service are refundable only in case of trip cancellation (visa refusal, flight cancellation, health problems), mistakes in the policy data discovered after payment, in case of erroneous payment. Refunds are made within 30 days after sending the refund request and in Ukraine's national currency. Refunds are made only if the policy has not activated yet.Content and intellectual property
The service is owned and controlled by Ensuria. All materials of the Service, including texts, images, design, graphics, information, logos, icons, audio and video recordings, interfaces, software, trademarks, brand names, etc. ("Content"), as well as copyright and other intellectual property rights to such Content is owned by Ensuria or posted with the consent of the copyright holder.The Content, or any elements thereof, may not be used without the prior written permission of Ensuria or its respective owners in any manner not provided for in these Terms.Subject to the provisions of these Terms, Ensuria grants you a limited, non-exclusive, revocable license, without the right to sublicense and transfer, to:- use the Service from your personal devices under the conditions set forth in this document; and
- access to and view any Content posted on or through the Service for personal, non-commercial use only.
- be truthful and credible;
- not contain obscene language, offensive comments related to race, national origin, gender, sexual preferences or physical disabilities;
- not contain unwanted or unauthorized advertising, spam or other forms of imposition;
- not promote violence and cruelty, not contain threats and not encourage violence against any person or animal;
- not be fraudulent and not violate any applicable laws, norms or rules;
- not violate the rights to privacy of third parties.
Third-party services and websites
Some features of the Service, such as making a payment, involve the use of third-party services and sites that Ensuria does not control.We are not responsible for the content and functionality that may be offered on such sites or such third-party services. You use such third-party sites and services at your own risk. We are not liable for any damages, risks or other monetary obligations arising from your use of such third-party sites or services.Please note that other terms of use and privacy policies apply to your use of third-party sites and services. In no case shall Ensuria be liable for personal data processed by third-party sites and services.Compensation for damages
To the fullest extent permitted by applicable law, you agree to indemnify, reimburse the damages and protect Ensuria, our partners, employees, contractors and agents, from any claims, liability, risks, damages and costs, including reasonable legal and accounting costs, in any way related to or arising from:- your violation of any of the provisions of these Terms,
- your use / improper use of the Service, Content, functions of the Service, or;
- your violation of any laws or third parties.
Applicable law and dispute resolution
These Terms are governed by and construed in accordance with the laws of Ukraine.If any material on the Service or your use of the Service violates the law of your location, the Service is not intended for you and we ask you not to use it. You are responsible for reviewing and complying with the laws of your country. Except as prohibited by applicable law and without limitation of consumer rights, you agree that any dispute, conflict, claim or dispute directly or indirectly related to the Service or these Terms, including, without limitation, those concerning their validity, interpretation or application should be resolved through peaceful negotiations directly with the Ensuria team in accordance with the principles of good faith and cooperation. If consensus cannot be reached through negotiations, the dispute should be resolved exclusively in the courts of Ukraine, in accordance with applicable legislation.All claims must be filed within one (1) year of their occurrence, unless applicable law requires a longer period.Emails
You understand and agree that we may send you a message to the contact details you provide in the Account regarding, in particular, (i) a notice of renewal of the Service; and (ii) information or materials relating to your use of the Service, including notices of insurance terms and policies purchased; (iii) information on updating these Terms.Disclaimer of Warranties
The service is provided on an "as is" basis. Unless expressly provided otherwise by these Terms or other policies of the Service, Ensuria disclaims all warranties, to the fullest extent permitted by law, with respect to the Service, its functionality and Content, including, without limitation, warranties of intent and non-infringement of third party intellectual property rights. other rightsWe make no promises or guarantees, in particular regarding the accuracy, usefulness, reliability and correctness of the Service. Ensuria does not warrant that the operation of the Service will be uninterrupted or secure, that any defects will be corrected or that the Service will be free of viruses or other harmful elements.Limitation of liability
Ensuria is not responsible if any information, materials, content available through the Service are inaccurate or incomplete, as well as for typographical errors or omissions in the text or other materials.In no case shall Ensuria, its employees or agents be liable for direct, indirect, incidental, special, awarded or incidental damages, including lost profits, data loss or damage to property, related to the use or inability to use the Service; for risks and damages resulting from the use of information or services received through the Service, as well as as a result of errors, defects and interruptions in the work of the Service, even if Ensuria was informed of the possibility of such damages.These waiver and limitation provisions apply to the maximum extent permitted by applicable law.Contacts
